RULES AND REGULATIONS
OFFICIAL RULES FOR THE DENVER TO MONTEREY SWEEPSTAKES
NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS SWEEPSTAKES. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING.
1. Eligibility: Denver to Monterey (the “Sweepstakes”) is open only to legal residents of the fifty (50) United States and the District of Columbia who are at least twenty-one (21) years old at the time of entry. Employees of Monterey County Convention and Visitors Bureau, and their parent and affiliate companies as well as the immediate family (spouse, parents, siblings and children) and household members of each such employee are not eligible. The Sweepstakes is subject to all applicable federal, state, and local laws and regulations and is void where prohibited. Participation constitutes entrant’s full and unconditional agreement to these Official Rules and Sponsor’s decisions, which are final and binding in all matters related to the Sweepstakes. Winning the Grand Prize is contingent upon fulfilling all requirements set forth herein.
2. Sponsor: Monterey County Convention and Visitors Bureau, 787 Munras Avenue, Suite 110, Monterey, CA 93940.
3. Timing: The Sweepstakes begins on September 17, 2018 at 12:00 a.m. Pacific Time ("PT") and ends on November 16, 2018 at 11:59 p.m. PT (the "Promotion Period"). Sponsor’s computer is the official time-keeping device for the Sweepstakes.
4. How to Enter: During the Promotion Period, visit www.seemonterey.com/denver and follow the links and instructions to complete and submit the registration form, including your name, email address, valid home address and phone number.
Limit: You may submit one (1) registration form per day during the Promotion Period. Multiple entrants are not permitted to share the same email address. Any attempt by any entrant to obtain more than the stated number of entries by using multiple/different email addresses, identities, registrations and logins, or any other methods will void that entrant's entries and that entrant may be disqualified. Use of any automated system to participate is prohibited and will result in disqualification. In the event of a dispute as to any registration, the authorized account holder of the email address associated with the account used to register will be deemed to be the entrant. The “authorized account holder” is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. The potential winner may be required to show proof of being the authorized account holder.
5. Grand Prize Drawing: Sponsor will randomly select the potential Sweepstakes winners from all eligible entries received during the Promotion Period, on or around November 20, 2018. The potential winners will be notified by email. Except where prohibited, the potential Grand Prize winners will be required to sign and return a Declaration of Compliance, Liability and Publicity Release ("Declaration") which must be received by Sponsor within seven (7) days of the date notice or attempted notice is sent, in order to claim the prize. If a potential winner of any prize cannot be contacted, fails to sign and return the Declaration or provide any other requested information, within the required time period, or the prize is returned as undeliverable, the potential winner forfeits the prize. Receiving a prize is contingent upon compliance with these Official Rules. In the event that the potential winner is disqualified for any reason, Sponsor will award the prize to an alternate winner by random drawing from among all remaining eligible entries. Only three (3) alternate drawings will be held, after which the prize will remain un-awarded. Grand Prizes will be fulfilled 8-10 weeks after winner confirmation.
6. Grand Prize: The prize package is outlined below.
A Monterey County, CA experience for two (2). Prize package includes two (2) roundtrip tickets from Denver to Monterey provided by United Airlines; two (2) nights' accommodations at Tally Ho Inn (single room, double occupancy); ATV vineyard tour for two (2) at Hahn Family Wines; admission to the Monterey Museum Bay Aquarium for two (2); one (1) dining certificate to The Beach House at Lovers Point; one (1) dining certificate to Abalonetti’s; one (1) dining certificate to Tarpy’s Roadhouse. Approximate Retail Value (“ARV”): $1,700.
For Prize Package: All prize components will be awarded as vouchers/certificates. Terms and conditions, including expiration dates, of vouchers and certificates apply. All prizes, including accommodations, wine tastings, tours, rentals, events and meals, are subject to availability and blackout dates. All prizes are subject to the terms and conditions set forth in this Sweepstakes. Prize packages do not include expenses and incidental travel costs not expressly stated in the package description above, including but not limited to, meals, incidentals, gratuities, passenger tariffs or duties, surcharges, service charges or facility charges, personal charges at lodging, security fees, taxes or other expenses are the responsibility solely of winner. Travel companions must be twenty-one (21) years of age or older as of the date of prize redemption and must travel on same itinerary and at the same time as the winner. Travel companion(s) must execute liability/publicity releases. Travel restrictions, conditions and limitations may apply. If winner is a legal resident of Alabama, Hawaii, Ohio, Oregon, Texas, or Utah, Sponsor will substitute the wine tasting and wine portions of the prize. Sponsor will not replace any lost, mutilated, or stolen tickets, vouchers or certificates. Sponsor is not responsible if any event is delayed, postponed or cancelled for any reason, in which event that portion of the prize is forfeited in its entirety and no substitution will be provided except as in Sponsor’s sole discretion. Winner will not receive the difference between actual and approximate retail value. Each Grand Prize is non-transferable and no substitution will be made except as provided herein at the Sponsor’s sole discretion. Sponsor reserves the right to substitute the prize (or a component thereof) for one of equal or greater value if the designated prize should become unavailable for any reason. Winner is responsible for all taxes and fees associated with prize receipt and/or use. Odds of winning a Grand Prize depend on the number of eligible entries received for each Grand Prize during the Promotion Period.
For Roundtrip United Airlines Airfare:
- The certificate is valid for the number of confirmed roundtrip ticket(s) as defined under credits in the authorization details. If issued for one-way travel, any unused portion will be forfeited.
- Offer valid only on flights operated by United or operated by other airlines and branded “United Express”. Otherwise, it is not valid on flights operated by other airlines, such as United-Marketed code share and Star Alliance flights.
- Itinerary must be a published fare routing.
- All travel must be completed by the expiration date listed under authorization details. Extension of the expiration date is not permitted under any circumstances.
- Open jaws are permitted.
- Stopovers and circle trip combinations are not permitted.
- Open tickets are not permitted.
- United reserves the right to limit the number of seats available for travel in conjunction with this offer.
- Customer is liable for all applicable taxes, fees and surcharges.
- MileagePlus miles will not be awarded.
- Space-available upgrade certificates may be used on day of departure provided all terms of the upgrade are met. All MileagePlus upgrade types (including Regional and Global Premier Upgrades) are not permitted. Purchased upgrades are permitted subject to availability.
- This certificate may not be used in conjunction with any other award, discount or offer. Customer will be required to provide positive identification.
- This offer is subject to any government approval and is invalid where prohibited by law.
- This certificate is nontransferable and is void if sold or exchanged for compensation. If this certificate is purchased, it is subject to confiscation and will not be accepted for travel.
- In the event of flight irregularity, alternate travel will be provided in the indicated class of service (subject to availability) only on United flights. United assumes no responsibility for any expenses, or tax liability in conjunction with the use of this offer and associated ticket(s) including, but not limited to expenses for accommodations, food or circumstances beyond the control of United.
- If you choose to ticket by calling United Reservations, please note that there will be a Reservation Ticketing Service Fee. Please advise the agent that you will be using an electronic ER1181 authorization (reference: GG Promo EER). Be prepared to provide the agent the promotion code, certificate PIN, class and travel area application listed under the authorization details.
- Not eligible for denied boarding compensation.
- Should you need to reissue, refund or void a ticket after you’ve redeemed your PIN credit(s), you will not receive a redeposit of the redeemed PIN credit(s).
- United reserves the right to change the terms and conditions of this offer without prior notice.
- United’s Contract of Carriage will be applicable to all travel undertaken, hereby.
7. Release: By receipt of any prize, winner agrees to release and hold harmless Sponsor and their respective subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies, and prize suppliers, and each of their respective parent companies and each such company’s officers, directors, employees and agents (collectively, the “Released Parties”) from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Sweepstakes or receipt or use or misuse of any prize.
8. Publicity: Except where prohibited, participation in the Sweepstakes constitutes each winner’s consent to Sponsor’s and its agents’ use of winner’s name, likeness, photograph, voice, opinions and/or hometown and state for promotional purposes in any media, worldwide, without further payment or consideration.
9. General Conditions: Sponsor reserves the right to cancel, suspend and/or modify the Sweepstakes, or any part of it, if any fraud, technical failures, human error or any other factor impairs the integrity or proper functioning of the Sweepstakes, as determined by Sponsor in its sole discretion. In such event, Sponsor, in its sole discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for any or all of the prizes offered herein. Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of the Official Rules of this or any other promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
10. Limitations of Liability: The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Sweepstakes; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Sweepstakes; (4) technical or human error which may occur in the administration of the Sweepstakes or the processing of entries; (5) late, lost, undeliverable, damaged or stolen mail; or (6) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Sweepstakes or receipt or use or misuse of any prize. If for any reason an entrant's entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant’s sole remedy is another entry in the Sweepstakes, if it is possible. No more than the stated number of prizes will be awarded. In the event that production, technical, seeding, programming or any other reasons cause more than the stated number of prizes as set forth in these Official Rules to be available and/or claimed, Sponsor reserves the right to award only the stated number of prizes by a random drawing among all legitimate, un-awarded, eligible prize claims. In no event will Monterey County Convention & Visitors Bureau be responsible or liable for any damages or losses of any kind, including direct, indirect, incidental, consequential or punitive damages arising out of access to and use of the Web site seemonterey.com, or the downloading from and/or printing material downloaded from said site. Without limiting the foregoing, everything on the site is provided "as is" without warranty of any kind, either express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose or non-infringement. Some jurisdictions may not allow limitations or the exclusions of liability for incidental or consequential damages, or exclusion of implied warranties, so some of the aforementioned limitations or exclusions may not apply. Check local laws for any restrictions or conditions regarding these limitations and/or exclusions. By accepting any prize, a winner shall indemnify, defend, protect and hold the Monterey County Convention & Visitors Bureau and all Released Parties free and harmless for any and all losses, costs, expenses, fees (including all reasonable attorneys fees), judgments or awards incurred by any of them relating to any injury, property damage or any other type of damage (monetary or otherwise) incurred or suffered by winner or winner’s family arising from, or directly or indirectly related to, their participation in this sweepstakes or any and all activities undertaken by any or all of them pursuant to the prize package that they won.
11. Disputes: Except where prohibited, entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes, the Official Rules or any prize awarded shall be resolved by binding arbitration in accordance with the California Code of Civil Procedure Section 1280 et. seq.; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorneys’ fees; (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased; and (4) by submitting any registration form for the Sweepstakes, entrant waives all rights to pursue any dispute or claim in a court of law and expressly agrees to resolve any disputes through binding arbitration. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of California without giving effect to any choice of law or conflict of law rules (whether of the State of California or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of California.

13. Winner: For a winner list, visit www.seemonterey.com/winner. The winner list will be posted after winner confirmation is complete.
